Welcome to CU Rewards

CU Rewards is a rewards program and system operated by Consumption Union Global Technology Sdn. Bhd. (referred to as "CU Rewards " or "we" or "us"). CU Rewards lets you earn CU Rewards's points (whether Gift Points, Bonus Points or otherwise) ("Points") by making qualifying purchases at certain designated retail and service companies ("Merchant Alliance(s)," whom we may also refer to as "partners") and through other promotions and offers that may be provided by Merchant Alliances or other merchants. Fully enrolled CU Rewards members ("Members") may use the Points they earn for other purchases at participating locations of specified Merchant Alliances.

For the avoidance of doubt, Gift Points have the same meaning with White Points in Chinese whereas Bonus Points have the same meaning with Red Points in Chinese.

There is no cost to join CU Rewards. However, we offer Platinum membership levels which cost RM999 for a lifetime membership, respectively. See "How Do I Become a Member?" below to learn how to join.

WHO IS ELIGIBLE?

To be eligible to enrol in CU Rewards, you must be at least 18 years of age or older. You hereby acknowledge and confirm that you have reached 18 years of age. If you are 18 years old
and below, you must obtain permission from your parent or legal guardian to join CU Rewards. CU Rewards may change these eligibility requirements at any time, and reserves the right to refuse membership to any applicant for any reason, in its sole and absolute discretion.

HOW DO I BECOME A MEMBER?

To become a Member, you must complete with the registration process described below.

When you enrol with us, we will request from you certain personal information, such as your name, address, gender, date of birth, e-mail address, and phone number and etc. (your "Registration Information"). We will also ask you to establish a username and password for online account access. You represent that all Registration Information you provide during enrolment and throughout your interactions with CU Rewards is true and accurate. You agree to update your Registration Information, as necessary to maintain its truth and accuracy. You are responsible for all activities related to your CU Rewards account and for maintaining the confidentiality of your username and password.

Additionally, in compliance with the Malaysia Personal Data Protection Act 2010 and regulations, please refer to these Terms and our latest Privacy Policy as stated in Appendix 1. The Privacy Policy applies to personal data previously provided by you to us as well as personal data you may provide to us in the future. Please contact us at support@CURewards.my if you do not consent to the processing of your personal data by us.

If you are registering from a country outside Malaysia, you should follow these steps on our official website www.CURewards.my

In the "member centre", select preferred language "Malay, English or Chinese"

Select "Sign-up Now" (Note: The Malaysia system currently does not have your membership information, you need to register, correctly fill in your membership ID and related information.)

Select "consumer members or business members," the correct choice of your place of residence, and check "I have read and agree to the cloud of user registration agreement".

Provide your "user name, ID card, password, email, etc.", please do not modify the "referee ID: ylhadmin" (Note: Since the Malaysia system does not have your membership information, nor your referrer information, you need to default ylhadmin as your referrer to complete your registration step).

Click on "Register Now" to complete the registration, the system automatically log in Member Centre Home.

HOW DO I EARN POINTS?

Members may earn Gift Points in various ways, which may include by:

• Making qualifying purchases to be determined by us from time to time;

• Redeeming offers and promotions at our Merchant Alliances;

•Using Associated Payment Cards (eCard) (if applicable).

Qualifying Purchases. Each Merchant Alliance will have different ways for you to earn Points. You will not receive Points for: items excluded by law; shipping amounts; the value of any merchant discounts or coupons; items and services that a particular Merchant Alliance or CU Rewards deems ineligible; or, in most cases, taxes. Please go to www.CURewards.my for more information about how and where you can earn Points at Merchant Alliances, including which items or services do not constitute qualifying purchases at that Merchant Alliances.

To earn Points on qualifying purchases, you need to present and use a CU Rewards identifier prior to purchasing qualifying items or services from participating Merchant Alliances' locations. Your primary CU Rewards identifier is your membership ID, phone number or email address which has been provided by you during the registration with CU Rewards.

Offers & Promotions. Some of our Merchant Alliances may provide you with additional ways to receive Points through offers, promotions, and other programs. Such offers and promotions may be subject to additional terms and conditions. Certain offers or promotions may require you to link a credit or debit card to your CU Rewards account and use that card to pay when you make a qualifying purchase. Where applicable, details will be provided on www.CURewards.my regarding how to link your credit or debit card.

Associated Payment Cards (if applicable). Certain payment cards associated with CU Rewards may be available to you ("Associated Payment Cards"). You are not required to have an Associated Payment Card to be a Member, but having an Associated Payment Card may provide you with additional ways to earn Points. Your CU Rewards card issued to you by CU Rewards is not an Associated Payment Card. You will need to separately apply for any Associated Payment Card, which will require you to undergo credit approval and will be subject to separate terms. Among other things, these separate terms may describe how and where you can earn Points, whether you need to link your CU Rewards card with your Associated Payment Card, and/or whether you need to present both your CU Rewards Identifier and the Associated Payment Card in order to earn Points.

HOW GIFT POINTS ARE EARNED

Consumer Members shall receive Gift Points to be calculated in this formula (RM1.00 = 100 Gift Points), based on the contribution amount provided by the Merchant Alliances to the Consumption Union Global Business System which has been developed and maintained by us ("Consumption Union Global Business System"), based on the total sales amount, into the members account. Gift Points are also earned through our approved consumer and business referrals ("Consumer and Business Referrals").

Merchant Alliances receive Gift Points equivalent to their contribution to the Consumption Union Global Business System, at 16% into the Merchant Member account. Gift Points are also earned through Consumer and Business Referrals.

Bonus Points - Business Members and Consumer Members receive Bonus Points, equal to real cash, through the Renewable Coin process in a daily cash drop to their account. Bonus Points consist of all Gift Points that have been converted to cash in the daily drop process.

Consumption Union Global Business System: Refers to the business model in the CU Rewards platform for the Business Member (Merchant) to make a cash contribution to the Pool Fund. Business Members' contribution shall be at the rate of 16% refundable deposit for each transaction delivered. The retail Member accounts, according to the rules of the system return for consumers and businesses.

GIF T POINT MATURATION

The system takes the total amount of Gift Points from both physical consumption and fund donation division on the member's day account as the weight reference of its share cooperation venture revenue. Each full 10,000 Gift Point integral as a measurement unit participates in the Bonus Point integral conversion, dissatisfied with a unit does not participate in the Bonus Point integral conversion metering settlement. The system is based on the overall operation of the platform and the consumption of a number of comprehensive factors, according to the actual revenue generated by the same day + the total amount of unallocated balance and the weight ratio of all Gift Points, calculate the return rate of each day (approximately 5 out of 10,000 (0.05%±) per day for physical consumption gift point reward, and approximate 3 out of 10,000 (0.03%±) per day for fund donation gift point reward, which both can be floating on this basis), convert Gift Points to Bonus Points, Bonus Points can continue to spend or to be withdrawn into your bank account which has been approved by CU Rewards. All Bonus Point transactions, whether for direct purchase or withdrawal to your bank account is subject to a 10% admin fee and 3% handling fee (when you withdraw to your bank account).

HOW CAN I USE POINTS?

For Savings on Purchases. Members can use Points for savings on purchases at certain Merchant Alliances. To use Points for savings, use your applicable CU Rewards Identifier before paying. You need to enter your security password, which you can create at www.CURewards.my

Unless explicitly stated otherwise, Cash Points may not be used for the purchase of any illegal products and/or services (included but not limited to the following: alcohol; tobacco; stamps; phone/prepaid/gift cards; money order/transfers; transportation passes; lottery tickets; charitable donations; prescriptions; pharmacy items or services).

What Happens to My Points if I Return Merchandise? If you return an item on which you earned a certain number of Points, we may deduct up to an equivalent amount of Points from your CU Rewards account. For example, if you earned 2000 Points for purchasing a t-shirt and then return that t-shirt, we may deduct 2000 Points from your CU Rewards account. Continuing this example, if you have fewer than 2000 Points in your CU Rewards account, we may deduct your remaining balance. If you used Points for savings on a purchase and then return the item purchased, the number of Points that you redeemed will generally be credited to your CU Rewards account. However, in some instances you may receive a store credit instead, depending on the policies of that Merchant Alliance. Whether or not an item that you have purchased can be returned is subject to the policies of each applicable Merchant Alliance and applicable laws and regulations. CU Rewards makes no representations and bears no responsibility for whether you can or cannot return any item you purchase.

When Do My Points Expire? Unlike other rewards programs, your Gift Points, Bonus Points and Stock Points will never expire.

MARKETING COMMUNICATIONS

By participating in the CU Rewards program, Member agrees to allow CU Rewards to communicate via mail, email, phone, external websites and various other channels. If permission is granted by the Member, CU Rewards may also communicate via text or mobile device. We may use these channels to communicate Member on account status, notify Member when they are eligible for a reward, communicate program changes, offer special Member promotions, offers, information and other messages that may be of interest to the Member.

SEPARATE TERMS AND CONDITIONS AND BENEFITS PROVIDED BY MERCHANT ALLIANCES

In addition to and independent of these Terms, Merchant Alliances and other merchants may have their own terms and conditions, which describe specifically how CU Rewards works at their locations. These terms and conditions may describe things such as how you earn Points at their locations, which items are excluded from earning Points and whether or not you need to link your CU Rewards account with the merchant's account in order to earn Points. In certain cases, the Merchant Alliance or merchant may also provide you with additional benefits that are not directly related to CU Rewards (e.g., price discounts on certain items). CU Rewards bears no liability under or responsibility for any Merchant Alliance- provided and conditions, or for any associated additional benefits, which are offered solely by the applicable Merchant Alliance or merchant, and may be changed or discontinued at that Merchant Alliance exclusive discretion.

CU Rewards shall not be held liable and/or responsible for any claim, loss, damage and/or expense incurred (whether directly or indirectly) by a Member or any other third party in relation to the independent and/or additional terms of the Merchant Alliances. The Merchant Alliances shall indemnify and hold CU Rewards harmless against all damages, liability, penalties, losses, actions, proceedings, costs, claims and expenses whatsoever that may be incurred or sustained by CU Rewards directly or indirectly as a result of any breach or non-performance of or failure to observe any of the independent and/or additional terms of the Merchant Alliances.

HOW CAN I MANAGE MY ACCOUNT?

You can create an account at www.CURewards.my and view the Points that you have earned and used. If you believe there is an error in your account balance, you can contact our customer service centre. We will review your claim and determine whether or not to adjust your balance, at our sole discretion. If you believe your CU Rewards account has been the subject of any suspicious activity, or if your CU Rewards card account identity has been lost or stolen, or if you have changed your phone number, please contact our customer service centre immediately at 010-7799845.

A CCOUNT CANCELLATION, INACTIVITY, TERMINATION AND DEATH

Cancellation by You. You may cancel your CU Rewards account at any time by calling our customer service centre at 010-7799845. If you cancel your CU Rewards account, any Points in your CU Rewards account will immediately be voided, and cannot be used after you cancel your account. Your membership fee in the sum of RM999 or your balance membership fee (as the case maybe) will be refunded within 60 days from the date of acceptance of cancellation by CU Rewards.

Termination by CU Rewards. We reserve the right to terminate your CU Rewards account at any time, or to modify or restrict your ability to use Points, immediately and without notice. We may do so for any reason, or no reason at all, including, but not limited to: if you violate these Terms, if you do not earn or use Points for two (2) or more years, if we determine that you are using your CU Rewards account for resale purposes, or if you act in a manner that is inconsistent with applicable laws or regulations. If we terminate your CU Rewards account, any Points in your CU Rewards account will immediately be voided and cannot be used.

Amendment of membership terms by CU Rewards. We may at our sole discretion provide a confirmation to you in writing or otherwise specifying the details of your membership. Such confirmation (if any) will be treated for all purposes to be correct and conclusive evidence of the details of your membership.

Effect of Cancellation and/or Termination . The cancellation and/or termination shall remain effective in perpetuity unless otherwise revoked by CU Rewards at its sole and absolute discretion. As such, you will be rejected for re-joining as a Member or Merchant Alliance after such cancellation and/or termination.

Death. In the event of death, your Points shall be transferred to your legal beneficiary(ies) as nominated by you in the CU Rewards's nomination form.

OUR RIGHTS TO MONITOR YOUR ACCOUNT

You hereby grant CU Rewards and its Merchant Alliances the right to monitor your CU Rewards account activity. We have the right to take any necessary legal action based on fraud, abuse, or suspicious activity in connection with your CU Rewards account or any of your activities relating to CU Rewards, and you agree to cooperate with any such action or investigation. If you are engaged in such activity, you may be liable for monetary losses, including litigation and/or arbitration costs and damages suffered by CU Rewards. This section shall survive the termination of CU Rewards or your CU Rewards account.

我们有权监控您的账户

您特此授予CU Rewards及其联盟商家监控您的CU Rewards账户活动的权力。我们有权根据与您的CU Rewards账户或您与CU Rewards相关的任何活动的欺诈,滥用或可疑活动采取任何必要的法律行动,并且您同意配合此类行动或调查。如果您从事此类活动,您可能需要承担金钱损失,包括诉讼和/或仲裁费用和损害赔偿。本节将在CU Rewards或您的CU Rewards账号终止后继续有效。

HOW CAN WE MODIFY THESE TERMS?

We may modify these Terms in any manner, at any time, in our sole discretion. Such changes may affect Points already received, including the opportunity to use such Points or their redemption rate. We will provide notice of modification on www.CURewards.my and by posting the revised Terms at www.CURewards.my and updating the last modified date. Be sure to check www.CURewards.my from time to time to ensure that you are aware of any changes to these Terms. Modifications to these Terms are effective immediately when posted. Except as set forth herein, modifications apply only to transactions and disputes that arise after the effective date. Your continued use of CU Rewards after changes have been made to these Terms constitutes your agreement to be bound by the modified Terms. If you do not agree to be bound by the modified Terms, your only recourse is to cancel your membership.

DISCLAIMERS

CU Rewards and its Merchant Alliances make no guarantees, warranties or representations of any kind concerning CU Rewards or Gift Points. All Points are void where prohibited by applicable laws or regulations, and these Terms are subject to immediate change if necessary to comply with such laws or regulations. You release and hold harmless us, our affiliates, and any participating Merchant Alliances or other merchants from all liability regarding your earning and use of Points or your participation in CU Rewards. The CU Rewards Malaysia program is only available in English. For Chinese and Malay language version, please visit www.CURewards.my. In the event of discrepancy, the English language version shall prevail.

We make no representations or warranties, either express or implied, including, but not limited to: any implied warranty of quality, condition, merchantability, fitness for intended use or a particular purpose, or those arising by statute or otherwise in law or from a course of dealing or usage of trade regarding CU Rewards or the services, materials, or goods advertised, promoted, sold or otherwise made available through a Merchant Alliance. You agree that your purchases of goods or services from a Merchant Alliance are between you and them, are made at your own risk, and are subject to any additional terms, conditions and restrictions between you and them. We have no responsibility for the delivery, standard, quality, safety, use, suitability or any other aspect of any goods or services ordered or purchased, except where required by law. Merchant Alliances are not the partners of CU Rewards.

Participating Merchant Alliances or participating Merchant Alliance locations may change at any time, and we may terminate or suspend CU Rewards's relationship with any Merchant Alliance or merchant without prior notice to you. A Merchant Alliance that is no longer participating in CU Rewards may still appear on marketing materials.

You acknowledge and agree that you have no ownership rights in Points or your CU Rewards account. You further acknowledge and agree that you have no third-party beneficiary rights in any agreement between us and any Merchant Alliance, and that the only relationship created by these Terms is one between you and us.

CU Rewards cannot be used where prohibited by laws and regulations or under any restriction. If any term of this agreement is found by a court to be illegal or not enforceable, except as otherwise provided in the Limitations on Arbitration subsection below, all other terms will still be valid and enforceable.

LIMITATION OF LIABILITY

Under no circumstances shall we, or any of our affiliates, or our or their vendors, or any Merchant Alliance be liable to you for any indirect, incidental, consequential, special, exemplary or punitive damages, whether any claim is based on warranty, contract, tort (including, without limitation, negligence) or otherwise (even if any of them have been advised of the possibility of such damages). This limitation of liability shall apply however damages arise, including, without limitation, whether such damages are incurred by third parties, and/or whether such damages arise from transactions between you and a Merchant Alliance, your use or misuse of CU Rewards, your inability to use CU Rewards, or the interruption, suspension, or discontinuation of CU Rewards.

In addition to any liability which you may otherwise have under the law, you undertake to indemnify (on a full Indemnity basis) us against any losses, liabilities or costs which we may incur due to:

  1. any misrepresentation in or breach of these Terms by you; or
  2. we are acting in accordance with the instructions given by you by facsimile or electronic transmission, the internet or the telephone.

We, any of our affiliate or any of our officers, employees or agents, will not be liable for any losses, liabilities or costs which may be caused by us acting upon any signature or document believed to be signed, or any verbal communication believed to be given, by a person authorized by you.

ASSIGNMENTS

Except as expressly set forth herein, you may not sell, assign or transfer any Gift Points you receive, any other aspect of your CU Rewards account, or any of your rights or obligations under these Terms, whether by operation of law or otherwise. We may sell, transfer, or assign the CU Rewards program, these Terms, or your CU Rewards account, in whole or in part, at any time, without notice to you. If we make such an assignment, the sole responsibility for the matters assigned, including any obligations to you, will lie with the party to which we make the assignment, and we will be released from any responsibilities or obligations.

DISPUTE RESOLUTION

This Agreement shall be construed and governed by the laws of Malaysia. In the case of dispute(s) between the Parties which cannot be resolved amicably, such dispute(s) shall then be submitted to arbitration which shall be conducted by KLRCA using a three (3) arbitrator panel selected by the Parties with the venue at Kuala Lumpur and such arbitration shall be settled / determined in accordance with the KLRCA Arbitration Rules.

We will not be liable for our failure to fulfil any obligations in relation to the Gift Points and any of our obligations in accordance with these Terms due to natural disasters, strike, riot, war, epidemic, pandemic, change of law or any other circumstances beyond our control.

TAXES

All payments of principal and interest (if any) and in relation to Gift Points under these terms will be made free and clear of and without deduction or withholding for or on account of any present or future taxes, duties or other governmental charges of whatsoever nature imposed or levied by or on behalf of any authority having power to tax unless we are required by the applicable law to deduct or withhold any such taxes, duties or other charges, in which event the we will make such deduction or withholding without your consent.

You have not relied upon our views or advice of or any of our affiliates in assessing the merits, risks and suitability of CU Rewards's membership and acknowledge that any communication, either written or verbal, received from us with respect to the CU Rewards membership is for the sole purpose of explaining the factual description of the Gift Points. Neither the Bank nor any of our affiliates is acting in a fiduciary capacity or as a financial adviser in respect of the Gift Points.

Notification of any matter in relation to CU Rewards program or membership shall be deemed given to you if it is made via any one of the methods below:

  1. by posting on our website at www.CURewards.my; or
  2. by sending an email to you who have provided email address to us; or
  3. by publication in a newspaper; or
  4. sending by ordinary post to your last known address appearing in our records

  3. user, member or customer relationship management procedures;
  4. the delivery of services or products and the marketing of such services or products whether present or future, to you;
  5. those purposes specifically provided for in any particular service or product offered by us;
  6. conducting marketing and client profiling activities in connection with our business, services and related products;
  7. for our internal record keeping;
  8. collection of outstanding payments;
  9. meeting any legal or regulatory requirements relating to our provision of services and products and to make disclosure under the requirements of any applicable law, regulation, direction, court order, by-law, guideline, circular, code applicable to us or any member companies of our Group;
  10. for the purposes of affiliate or membership management; and
  11. purposes relating to any of the above (including but not limited to research, benchmarking and statistical analysis).

  6. our sub-contractors or third party service or product providers as may determine to be necessary or appropriate;

  6. withdraw, in full or in part, your consent given previously, in each case subject to any applicable legal restrictions, contractual conditions and a reasonable time period.
